ಹೊಸದಿಲ್ಲಿ, ಮೇ : (www.justkannada.in news) ಕಾನೂನುಬಾಹಿರ ಚಟುವಟಿಕೆಗಳ ತಡೆ ಕಾಯ್ದೆ (ಯುಎಪಿಎ) ಪ್ರಕರಣದಲ್ಲಿ ದೆಹಲಿ ಪೊಲೀಸರು ಬಂಧಿಸಿರುವುದನ್ನು ಪ್ರಶ್ನಿಸಿ ನ್ಯೂಸ್‌ಕ್ಲಿಕ್ ಸಂಪಾದಕ ಪ್ರಬೀರ್ ಪುರ್ಕಾಯಸ್ಥ ಅವರ ಅರ್ಜಿಯನ್ನು ಆಲಿಸಿದ ನಂತರ ಅವರನ್ನು ಬಿಡುಗಡೆ ಮಾಡುವಂತೆ ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಬುಧವಾರ ಆದೇಶಿಸಿದೆ.

ನ್ಯಾಯಾಧೀಶರಾದ ಬಿಆರ್ ಗವಾಯಿ ಮತ್ತು ಸಂದೀಪ್ ಮೆಹ್ತಾ ಅವರ ಪೀಠವು ರಿಮಾಂಡ್ ಪ್ರತಿಯನ್ನು ಒದಗಿಸಿಲ್ಲ ಮತ್ತು ಇದು ಬಂಧನವನ್ನು ದುರ್ಬಲಗೊಳಿಸಿದೆ ಮತ್ತು ಬಂಧನವನ್ನು 'ವಿರೋಧಿ' ಎಂದು ಪರಿಗಣಿಸಲಾಗಿದೆ ಎಂದು ಹೇಳಿದರು.

ಜಾಮೀನು ಬಾಂಡ್‌ಗಳನ್ನು ಒದಗಿಸುವ ವಿಚಾರಣಾ ನ್ಯಾಯಾಲಯದ ತೃಪ್ತಿಯ ಆಧಾರದ ಮೇಲೆ ಬಿಡುಗಡೆ ಮಾಡಲಾಗುವುದು ಎಂದು ನ್ಯಾಯಾಲಯ ಹೇಳಿದೆ.

ಯುಎಪಿಎ ಅಡಿಯಲ್ಲಿ ಕಳೆದ ವರ್ಷ ದೆಹಲಿ ಪೊಲೀಸರು ಬಂಧಿಸಿದ್ದ ಪುರ್ಕಾಯಸ್ಥನ ಬಂಧನ ಮತ್ತು ರಿಮಾಂಡ್ ಅನ್ನು ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಅಸಿಂಧುಗೊಳಿಸಿದೆ.

ಪ್ರಕರಣದ ಆರೋಪಪಟ್ಟಿ ಸಲ್ಲಿಕೆಯಾದ ಕಾರಣ ಅವರನ್ನು ತಕ್ಷಣ ಜಾಮೀನಿನ ಮೇಲೆ ಬಿಡುಗಡೆ ಮಾಡುವಂತೆ ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಆದೇಶಿಸಿದೆ.  ವಿಚಾರಣಾ ನ್ಯಾಯಾಲಯವು ಜಾಮೀನು ಶ್ಯೂರಿಟಿ ಷರತ್ತುಗಳನ್ನು ವಿಧಿಸಲಿದೆ ಎಂದು ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಹೇಳಿದೆ.

the Supreme Court on Wednesday ordered the release of NewsClick Editor Prabir Purkayastha after hearing his plea, challenging the arrest by Delhi Police in a Unlawful Activities Prevention Act (UAPA) case.

A bench of Justices BR Gavai and Sandeep Mehta said the Remand copy was not provided and this vitiated the arrest and the arrest was thus held as 'VOID'. The court said that the release would be done on the basis of satisfaction of the trial court on furnishing of bail bonds.

The top court invalidated the arrest and remand of Purkayastha, who was arrested by the Delhi Police last year under UAPA. The Supreme Court ordered his immediate release on bail since the chargesheet in the case has been filed. The trial court stands to impose bail surety conditions, the top court added.
